1. Agreement to Terms

By accessing or using the Blue Flame Soul website at blueflamesoul.com, placing an order, or booking a session, you agree to be bound by these Terms of Service. If you do not agree, please do not use our site or services. These terms apply to all visitors, customers, and others who access or use our site.

2. About Blue Flame Soul

3. Products and Orders

We reserve the right to limit quantities, discontinue products, or correct pricing errors at any time. Product descriptions and images are provided in good faith and are as accurate as possible; slight variations in color, size, or appearance may occur, particularly with natural items such as crystals and stones, as these are products of nature and each one is unique.

We reserve the right to refuse or cancel any order at our discretion, including orders that appear fraudulent or that we are unable to fulfill.

4. Pricing and Payment

All prices are listed in U.S. dollars. We accept major credit and debit cards and PayPal. Payment is collected at the time of purchase or booking. We reserve the right to change prices at any time without prior notice; price changes will not affect orders already confirmed.

5. Shipping

Physical products are shipped to addresses within the United States. Processing times, shipping rates, and carrier information are detailed in our Shipping Policy. Blue Flame Soul LLC is not responsible for delays caused by carriers, customs, or circumstances outside our control. Risk of loss and title for physical products pass to you upon delivery to the carrier.

6. Energy Sessions — Important Disclaimer

Reiki, distance energy sessions, animal sessions, and all other energy wellness services offered by Blue Flame Soul are complementary wellness practices only. They are not a form of medical treatment, diagnosis, or therapy, and are not a substitute for professional medical, psychological, psychiatric, or veterinary care. Julie C. Holloway is an ICRT-certified Reiki Master Teacher; she is not a licensed medical or mental health professional.

By booking a session, you acknowledge that you are participating voluntarily, that you have disclosed any relevant health information in your intake form, and that you release Blue Flame Soul LLC, Julie C. Holloway, and Destre A. Holloway from any liability arising from your participation.

All session bookings are subject to our Refund & Return Policy.

7. Digital Downloads

Digital products are delivered electronically and are non-refundable once accessed or downloaded. You may use digital downloads for personal, non-commercial use only. Redistribution, resale, or sharing of digital files is prohibited.

8. Intellectual Property

All original paintings, aura portraits, essence portraits, prints, and visual artwork created by Destre A. Holloway is the exclusive intellectual property of Destre A. Holloway and Blue Flame Soul LLC. Purchase of a physical print or original work does not transfer copyright or any right of reproduction, distribution, or commercial use. No artwork, images, text, or other content from this site may be reproduced, altered, published, sold, or used in any commercial or public context without the prior written consent of Destre A. Holloway and Blue Flame Soul LLC.

Blue Flame Soul LLC may also offer original artwork and prints created by independent and consignment artists. All such works remain the exclusive intellectual property of their respective creators. Purchase of any artwork offered through Blue Flame Soul LLC — regardless of the creating artist — does not transfer copyright or any right of reproduction, distribution, or commercial use. Buyers may not reproduce, alter, publish, sell, or otherwise use purchased works for commercial purposes without the prior written consent of the original artist.

9. Aura and Essence Portrait Sessions

Aura and essence portrait sessions are artistic and intuitive in nature. The resulting work reflects the practitioner's creative interpretation and energetic perception and is not a scientific or medical representation. Results vary by individual. All portrait session fees are non-refundable.

 

In-Person Sessions.

For aura and essence portrait sessions conducted in person, the original oil painting will be presented to you at the conclusion of your session. Prior to release, the painting will be photographed by Blue Flame Soul LLC, and all images of the work remain the exclusive intellectual property of Destre A. Holloway and Blue Flame Soul LLC, subject to the terms in Section 8. Because oil paint requires an extended period to dry and cure, the painting you receive at the end of your in-person session will not yet be fully cured. You assume full responsibility for the proper care, curing, and varnishing of your painting upon receipt. Blue Flame Soul LLC and Destre A. Holloway are not responsible for any damage, deterioration, or loss that occurs after the painting has been released to you. We are happy to provide care and curing guidance upon request.

 

Virtual & Distance Sessions — Digital Delivery.

Following your virtual or distance session, you will receive a high-resolution digital download of your portrait within 24 hours. This digital file is for your personal use only and is subject to the Intellectual Property terms set forth in Section 8.

 

Virtual & Distance Sessions — Original Oil Painting.

Each aura and essence portrait is an original oil painting created uniquely for you. Because oil paint requires time to dry and cure — a process that varies based on the thickness of paint application and can range from several weeks to several months — we are unable to provide a fixed delivery date for the original painting at the time of your session. We will not ship or release the original painting until it has fully cured and been protected with a professional-grade gloss varnish.

 

Delivery & Pickup Notification.

Once your painting is cured, varnished, and ready, we will make three attempts to contact you via email and/or phone to arrange delivery or pickup. If you are local to Lincoln, Nebraska, we will notify you that your painting is available for in-person pickup. If you require shipping, we will contact you to confirm your current mailing address before the painting is shipped. Shipping costs for original paintings are the responsibility of the customer and will be communicated at the time of delivery notification.

 

Customer Contact Responsibility.

You are responsible for ensuring that we have your current and accurate contact information — including phone number, email address, and mailing address — at all times. Blue Flame Soul LLC is not responsible for failed delivery of notifications due to outdated or incorrect contact information provided by the customer.

 

Unclaimed Paintings.

If we are unable to reach you after three contact attempts and do not receive a response within 30 days of our first attempt, your original painting will become the property of Blue Flame Soul LLC and may be offered for sale to others. No refund will be issued in this circumstance. It is your responsibility to maintain current contact information with us and to respond to delivery notifications in a timely manner.

10. User Conduct

You agree not to use this site for any unlawful purpose, to submit false or misleading information, to attempt to gain unauthorized access to any part of the site, or to engage in any conduct that could damage, disable, or impair the site or interfere with any other party's use of it.

11. Third-Party Links and Services

Our site may contain links to third-party websites or integrate third-party tools such as Acuity Scheduling. These are provided for convenience only. Blue Flame Soul LLC is not responsible for the content, privacy practices, or terms of any third-party site or service.

12. Limitation of Liability

To the fullest extent permitted by law, Blue Flame Soul LLC, its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this site, our products, or our services. Our total liability to you for any claim shall not exceed the amount you paid for the product or service giving rise to the claim.

13. Disclaimer of Warranties

This site and its contents are provided "as is" without warranties of any kind, either express or implied. We do not warrant that the site will be uninterrupted, error-free, or free of viruses or other harmful components.

14. Governing Law

These Terms of Service are governed by the laws of the State of Nebraska, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Lancaster County, Nebraska.

15. Changes to These Terms

We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated date. Your continued use of the site after any changes constitutes your acceptance of the revised terms.
